There Are Four Steps To Obtaining An Annulment in Nevada
STEP 1:
Determine if you have grounds for annulment by either calling us at 702-420-7052 or Contact us: we’ll reply promptly and tell you whether you are eligible to file for an annulment in Nevada.
There is no time limit to file an annulment in Nevada, however, judges do take the length of the mariage into consideration when deciding whether to grant an annulment.
STEP 2:
To proceed with your annulment immediately, complete your Secure Form. The ready-to-sign documents will be emailed to you in no later than 24 hours after receiving the form (excluding weekends and holidays unless it’s a RUSH case), and provided we have all of your information.
STEP 3:
Once we receive your signed and notarized documents, your annulment will be filed and processed through the appropriate Nevada Family Court System for your type of annulment case. Your annulment is granted on average 1 to 2 weeks later, three weeks if the court or your judge happens to be very busy when your case is filed. (when both parties sign).
It does happen often enough that an annulment is granted in just days when both parties sign, but we don’t make that promise since it highly depends on how busy the court is at the time your case is filed, and also depends on how busy the judge to whom your case is assigned happens to be at the time your case is filed.
If only one party signs the annulment documents, and provided the Defendant does not contest the annulment (such as contesting the valid reason for annulment given in the Complaint), your annulment will be granted in about 8-16 weeks – see the Complaint for Annulment (one-signature) page for more detailed information. The exact length of time it takes to finalize a one-signature annulment depends on whether the Defendant can be served personally or must be served by publication, and also the pace at which your judge processes Nevada marriage annulments.
THE FINAL STEP:
We e-mail the final Decree of Annulment to you as soon as it becomes available to us.
Hearings:
There are NO court hearings for annulments in Nevada for a large majority of cases unless your spouse contests the annulment. Our office NEVER requires you to attend a hearing. This is ALWAYS up to your judge. If yours is the rare case that necessitates a hearing even when your case is not contested, there is a higher than 99.99% chance you’ll be able to appear by phone instead of in person because Attorney James E. Smith is physically present in the courtroom representing you!
